The introduction of the commercial court as a separate court within the high court has reduced significantly the time in which commercial disputes can be heard in the high court. This court however is not impressed with litigants that have not already proceeded through a mediation process and in a large number of cases will be referred back to mediation if the parties have not already been through this process. Consequently a significant number of cases are now being settled under mediation with the courts giving their legal sanction on same.
